I just made Eugene Moon (R-Gainesville) aware of some legal research I conducted today as amicus curiae.  Eugene filed a compliant contesting the election he narrowly lost to Billy Powell on July 31, 2012.  You can read my prior piece about the suit here.  A visiting judge dismissed the action on Monday, September 17, 2012 based upon a procedural technicality.  With all respect to Judge Adamson (who is a fine jurist before whom I have have had the pleasure to appear before on several occasions), I believe an error was made.  If I am correct, it is a reasonable error based upon a poorly worded statute.  And if I’m correct, then Eugene will be able to bring into the open in court the many errors committed during the last election cycle.  I wonder where Secretary of State Brian Kemp is in all of this.  It is my sincere hope that such errors can be corrected in the future.  If the ballot box is not secure then our very liberty is in doubt.

As a side note, Times reporter Ashley Fielding informed me that today is her last day with the paper.  I wish her luck in all of her future endeavors.  Her balance writing will be missed.
